An extremely high level terrorist was recently captured in Pakistan, but we&#8217;re not going to question him. Thanks to Barack Obama&#8217;s new warm and fuzzy version of the War on Terror we don&#8217;t do things like that anymore.</p><blockquote><p>He&#8217;s considered one of world&#8217;s most dangerous terrorism suspects, and the U.S. offered a $1-million reward for his capture in 2005. Intelligence experts say he&#8217;s a master bomb maker and extremist leader who possesses a wealth of information about <a id="ORCIG000003751" title="Al-Qaeda" href="http://www.latimes.com/topic/unrest-conflicts-war/terrorism/al-qaeda-ORCIG000003751.topic">Al Qaeda</a>-linked groups in Southeast Asia.</p><p>Yet the U.S. has made no move to interrogate or seek custody of <a id="PLGEO000001578" title="Bali (Indonesia)" href="http://www.latimes.com/topic/intl/indonesia/bali-%28indonesia%29-PLGEO000001578.topic">Indonesian</a> militant Umar Patek since he was apprehended this year by officials in<a id="PLGEO00000020" title="Pakistan" href="http://www.latimes.com/topic/intl/pakistan-PLGEO00000020.topic">Pakistan</a> with the help of a <a id="ORGOV000009" title="CIA" href="http://www.latimes.com/topic/politics/espionage-intelligence/cia-ORGOV000009.topic">CIA</a> tip, U.S. and Pakistani officials say.</p><p>The little-known case highlights a sharp difference between <a id="PEPLT007408" title="Barack Obama" href="http://www.latimes.com/topic/politics/government/barack-obama-PEPLT007408.topic">President Obama</a>&#8216;s counter-terrorism policy and that of his predecessor,<a id="PEPLT000857" title="George Bush" href="http://www.latimes.com/topic/politics/government/presidents-of-the-united-states/george-bush-PEPLT000857.topic">George W. Bush</a>. Under Obama, the CIA has killed more people than it has captured, mainly through drone missile strikes in Pakistan&#8217;s tribal areas. The other is that interrogators are still living under the threat of prosecution from Eric Holder and his rogue DOJ. This has created an atmosphere of hesitation and fear in the intelligence community. Discovered under a desk, the recordings could provide an unparalleled look at how foreign governments aided the U.S. in holding and questioning suspected terrorists.</p><p>The two videotapes and one audiotape are believed to be the only remaining recordings made within the clandestine prison system.</p><p>The tapes depict Binalshibh&#8217;s interrogation sessions at a Moroccan-run facility the CIA used near Rabat in 2002, several current and former U.S. officials told The Associated Press. They spoke on the condition of anonymity because the recordings remain a closely guarded secret.</p></blockquote><p>Some guy at CIA found the tapes in a box stuck under a desk and forgotten about. Things have been very quiet &#8212; a little too quite.</p><p>That uneasy calm was shattered today as Democrats tried a <a href="http://michellemalkin.com/2010/02/25/gop-beats-back-sneak-attack-on-cia-interrogators/" target="_blank">sneak attack</a> on the intelligence community in the form of a last minute addition to the intel bill.</p><p>Stashed in the new intelligence bill literally in the dark of night were 11 pages that banned “degrading” treatment of detainees. Interrogators would face 15-years in prison if something they did was ruled “degrading” by this left-wing Congress.</p><p>So-called degrading treatment “includes but is not limited to” exploiting phobias, hooding detainees, sleep deprivation, extreme temperatures, and anything else the gutless bureaucrats decide.</p><p>The American people had no idea what they were doing when they put this radical bunch of miscreants in charge. Hayden said in an interview on Friday. &#8220;Other speculations that it may have been made in other compounds, in other parts of the capital region, are simply wrong.&#8221;</p></blockquote><p>It was the head of Clandestine Services, Jose Rodriguez who acted against the earlier advice of at least five senior CIA and White House officials, who had counseled the agency since 2003 that the tapes should be preserved.</p><p>Rodriguez consulted CIA lawyers and officials, who told him that he had the legal right to order the destruction. In his view, he received their implicit support to do so, according to his attorney, Robert S. Bennett.</p><p>I&#8217;m betting that after all is said and done that Mr. Rodriguez will be seen as having acted lawfully when he ordered the destruction of the interrogation tapes.</p><p>Mr. Rodriguez is a patriot and deserves a great deal of thanks. He knew it was only a matter of time before some traitor at the agency got a hold of those tapes and presented them to the NY Times with a big red bow on them.</p><p>Those tapes should have never been made in the first place, because our government is incapable of keeping secrets.
