Even though I disagree with his judicial philosophy almost entirely, I still like hearing from him. Breyer has a superior intellect and is the caliber of person who should be serving on The Supreme Court. Again, I’m talking about his intelligence and grasp of the law not his interpretation of it. Margie Phelps, daughter of Fred Phelps, argued her family&#8217;s case today in front of the court.</p><p>The case is officially known as <em><a href="http://althouse.blogspot.com/2010/10/margie-phelps-daughter-of-fred-phelps.html" target="_blank">Snyder v. Phelps</a></em> and at issue is whether the First Amendment protects protesters at a funeral from liability. Now SCOTUS must decide if the Phelps family is liable for the harm caused by those outrageous protests.</p><p>If the entire Phelps family were hit by a truck tomorrow I would be quite pleased. They are among the most despicable creatures this country has ever produced.</p><p>However, I’m very torn about this case. It should be illegal to protest the way they’re protesting. But at the same time I’m not sure if it really <em>should</em> be. It really is a slippery slope when you begin curtailing free speech. You would hope that most people would have enough decency not to use their free speech rights in such a malicious and hateful way, but that’s not the case.</p><p>It seems to me a happy medium would be to simply impose a distance regulation. But I’m no lawyer so I don’t know. It’s about socialism in New York City from 1900-1933. One could argue that it’s purely an academic paper, but parts of it suggest otherwise. The paper leaves little doubt that she’s at the very least an admirer of socialism if not an outright supporter of it.</p><p>Here’s a little taste:</p><blockquote><p>“Radicals have often succumbed to the devastating bane of sectarianism; it is easier, after all to fight one’s fellows than it is to battle an entrenched and powerful foe. In unity lies their only hope.”</p></blockquote><p>One more for the road…</p><blockquote><p>“The story is a sad but also a chastening one for those who, more than half a century after socialism’s decline, still wish to change America.</p></blockquote><p>Judging from pretty much everyone else Obama has appointed to anything you can bet Kagan is a radical leftist. She’s a perfect candidate because she’s never been a judge and barely spent anytime in private practice as a lawyer. That means her paper trail is very thin &#8212; which means there’s little ammunition for Republicans to attack.</p><p>However, Obama is a good friends with Kagan. He knows who she is and what she believes about a wide range of issues. Therefore, his decision to pick her for a lifetime appointment to the highest court in the land wasn’t done on the fly. You can bet your ass she’s a radical. I wouldn’t be surprised if she turns out to be the most radical justice on the court &#8212; ever. I wouldn’t be surprised if she ends up making Ginsburg look more like Roberts.</p><p>Obama isn’t capable of picking a moderate for anything. The Obama administration decided [...]]]></description> <content:encoded><![CDATA[<p></p><p>It looks like the U.S. Constitution may have a fighting chance after all.</p><p>The Supreme Court has <a href="http://hotair.com/archives/2009/06/08/breaking-scotus-stops-chrysler-sale/" target="_blank">stepped in</a> and temporarily blocked the sale of Chrysler to Fiat.</p><p>Justice Ruth Bader Ginsburg signed an order temporarily stopping the sale and may decide to have the matter heard by the entire court.</p><p>The Obama administration decided to cast aside the law and make up their own bankruptcy rules to reward the union and hose bond holders.</p><p>The Chrysler deal is blatantly unconstitutional and it’s almost inconceivable that the Supreme Court would allow it to go through.</p><p>Obama and his auto task force are acting like a bunch of gangsters and hopefully the Supreme Court is about to put them in check.</p> ]]></content:encoded> <wfw:commentRss>http://www.thehotjoints.com/2009/06/08/supreme-court-halts-chrysler-sale/feed/</wfw:commentRss> <slash:comments>1</slash:comments> </item> <!-- google_ad_section_end --></channel> </rss>
