The U.S. Supreme Court agreed Monday to rule on a politically charged law in Arizona targeting illegal immigrants.

The New Yorker has a lengthy profile of Supreme Court Justice Clarence Thomas and his wife Ginni. Not surprisingly, It’s a left wing piece of centering around the right wing “activism” of Justice Thomas and his wife, especially as it relates to ObamaCare. But it’s still an interesting piece with fairly in-depth analysis of Thomas’s views of the Constitution and the law. It’s worth reading.

WASHINGTON (AP) — The Supreme Court ruled Wednesday that the First Amendment protects fundamentalist church members who mount anti-gay protests outside military funerals, despite the pain they cause grieving families.

The court voted 8-1 in favor of the Westboro Baptist Church of Topeka, Kan. The decision upheld an appeals court ruling that threw out a $5 million judgment to the father of a dead Marine who sued church members after they picketed his son’s funeral.

Chief Justice John Roberts wrote the opinion for the court. Justice Samuel Alito dissented.

Supreme Court Justice Stephen Breyer was on “Fox News Sunday” over the weekend to flog his new book. Even though I disagree with his judicial philosophy almost entirely, I still like hearing from him. Breyer has a superior intellect and is the caliber of person who should be serving on The Supreme Court. Again, I’m talking about his intelligence and grasp of the law not his interpretation of it. His belief that the Constitution is a living document that changes with the times is dead wrong in my view.

I know I’m supposed to be outraged about this, but there’s just too many things to be outraged about. My outrage is running on fumes.

Lindsay Graham has announced that he’ll be voting to confirm Elena Kagan to the Supreme Court. I know — stunning.

Everybody knew going into this thing how it would shake out. Kagan would ultimately be confirmed and Lindsey Graham would vote for her.

He reiterated what he always says and what we all knew he would say:

Blah…blah…blah…blah…elections have consequences…blah…qualified…blah…blah…(lofty rhetoric)…blah…blah.

I agree that Kagan is qualified. I get the sense that she really does have a heavyweight intellect unlike Sonia Sotomayor — who’s clearly a lightweight.

There’s also NO DOUBT that she’s as liberal as they come. Yeah, there’s not an extensive paper trail but there doesn’t need to be.

The fact that Barack Obama nominated her tells you everything you need to know. She’s a far-left progressive who will legislate from the bench.

Fortunately, she’s merely replacing a justice who already does that.

Take a listen to left-wing Solicitor General Elena Kagan as she argues before the Supreme Court. This is from the Citizens United v. Federal Election Commission case. Suffice it to say, Kagan lost. I remember listening to this case at the time and thinking what a weak lawyer she was. Not surpassingly, Obama picked her for the Supreme Court.  Where do liberals learn these bizarre legal theories? Are we reading the same Constitution?

Here’s President Obama nominating Solicitor General Elena Kagan to be the next Supreme Court Justice. Kagan has never been a judge and has only 2 years of private practice experience as an attorney. Her only real claim to fame was as the Dean of Harvard Law School from 2003-2009 where she tried to kick military recruiters off campus.

As is always the case with President Obama this was about identity politics and nothing more. Kagan like Sotomayor is not the best and the brightest this country has to offer, but she’s a liberal and a woman.

Obama wants to be able to say three women now sit on the highest court, rather than the best legal minds (regardless of their gender or racial make-up).
